Terms of Service

These Terms of Service ("Terms") govern your access to and use of Updaytr's services, websites, and related applications (the "Services"). By using the Services, you agree to be bound by these Terms.

Eligibility and Account

You must be at least 13 years old to use the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

Subscriptions and Billing

Access to certain features requires a paid subscription. Fees are billed in advance and are non-refundable except where required by law. You may cancel at any time; service continues until the end of the current billing period.

Acceptable Use

• Do not misuse the Services or attempt to disrupt or compromise security.
• Do not upload unlawful, infringing, or harmful content.
• Do not use the Services to collect or process sensitive data without prior written consent.
• Respect third-party rights and comply with applicable laws and regulations.

Data, Privacy, and Security

You retain ownership of the content you submit to the Services. We handle personal data as described in our Privacy Policy. We implement measures designed to protect data; for details see our Security & Compliance page.

Compliance Disclaimers

• HIPAA: Updaytr is not currently HIPAA compliant. You must not use the Services to store or transmit protected health information (PHI).
• SOC 2: Updaytr is not SOC 2 certified at this time. SOC 2 compliance is on our roadmap but not yet achieved.

Third-Party Services

We use subprocessors to provide portions of the Services (e.g., Supabase, Retell AI, OpenAI, Resend, Stripe). Your use of third-party services may be subject to their terms and privacy policies.

Intellectual Property

We retain all rights to the Services and related intellectual property. You receive a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Reports generated by the Services may contain errors due to audio quality, accents, or model limitations. You are responsible for reviewing and validating reports before relying on them.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

Termination

You may stop using the Services at any time. We may suspend or terminate access for violations of these Terms. Upon termination, your right to access the Services ceases.
